Here a high ranking Pharisee's named Nicodemus acts on his faith, knowing that no man on earth could perform the works Christ was doing if they weren't of God, but why the controversy? The controversy is as it is today, rules and laws, which stop Spirit and truth denying it by judgment and blindness through laws created for wicked people.
1Tim.1:9 as knowing this, that law is not made for a righteous man, but for the lawless and insubordinate, for the ungodly and sinners, for the unholy and profane, for murderers of fathers and murderers of mothers, for manslayers, 1:10 for the sexually immoral, for homosexuals, for slave-traders, for liars, for perjurers, and for any other thing contrary to the sound doctrine;
The law was the legal book for Pharisees whom weren't concerned with God's righteousness as much as they were concern making people obey the law, confusing themselves with disillusionment that they could some how keep the law perfectly. However, Christ was not acting from the law, he was acting with Spirit, and the truth, what truth? The truth of God, his Father whom he loved with his whole soul, mind, and spirit. Yes, Christ was showing, not talking, or acting in legal terms how God personality really is through his works for God. John 15:24 If I hadn't done among them the works which no one else did, they wouldn't have had sin. But now have they seen and also hated both me and my Father.
Nicodemus got the message which frighten him, although it appeared Christ was breaking the law, his works showed he was of God. Nicodemus realized there was more to this man than the law could convicted him of evil. Christ does not answer Nicodemus, but instead makes a statement that actually explained everything. He says: "Most certainly, I tell you, unless one is born anew,{The word translated "anew" here and in John 3:7 (anothen) also means "again" and "from above".} he can't see the Kingdom of God."
1 John 3:6 Whoever remains in him doesn't sin. Whoever sins hasn't seen him, neither knows him.
One could not be born anew by the law, one could not become sinless by the law, one could not be eternally declared righteous by the law, thus, one could not judge the works of God by a law that accounted every man evil.
Romans 14:4 Who are you who judge another's servant? To his own lord he stands or falls. Yes, he will be made to stand, for God has power to make him stand.
The works of God through Christ was the reality not the shadow of the prophets or the law, it was a profound awesome experience coming into direct contact with God working through a sinless man, not judged by the law of wicked. How do you make evil stick to God's righteousness, Christ Jesus? How to you file accusation against a sinless person? How do you impute wickedness to a person God is not judging because they are sinless, not unless you hope they fall into wickedness so they can be right?
Luke 19:22 "He said to him, 'Out of your own mouth will I judge you, you wicked servant! You knew that I am an exacting man, taking up that which I didn't lay down, and reaping that which I didn't sow.
Here than would be the judgment of entire nation for just such unrighteous judgments of the sinless Son of God. Yes, the righteous law of God was not for the righteous, but the wicked, and each person under it should have known they could not keep it on their very best day, by simply looking at the blood upon the altar of God shed for their sins!
